Sell Your Gadgets – User Agreement

Welcome to Sell Your Gadgets® (“Sell Your Gadgets,” “we,” “us,” or “our”). These terms govern your use of our website, mail-in service, and in-store trade-in program (collectively, the “Services”). By selling, trading, or mailing us a device, you agree to this User Agreement and our Privacy Policy.


1. Acceptance of Terms

By using our Services, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, please do not continue to use the Services. We may update these terms periodically; continued use after an update means you accept the revised terms.

2. Eligibility & Account Responsibilities

You must be at least 18 years old to participate. You agree that all information you provide is accurate and complete, and that you are the lawful owner of any device sold or traded. We reserve the right to request identification to verify eligibility or ownership.

3. Description of Services

  • In-Store Trade-Ins: Visit any Sell Your Gadgets location for on-the-spot evaluation and same-day payment.
  • Mail-In Program: Request a prepaid shipping label, send your device to our processing center, and receive payment after inspection.
  • Device Valuations: Initial quotes are based on the details you submit. Final offers depend on our physical inspection results.

4. Your Obligations

  • Provide truthful, current, and complete device information (model, storage, condition, etc.).
  • Back up and erase all personal data, remove SIM/SD cards, and sign out of any linked accounts.
  • Do not attempt to sell or trade in stolen, counterfeit, or activation-locked devices.
  • Comply with all applicable export, data, and trade laws.

Fraud Notice: Devices reported lost, stolen, or blacklisted may be confiscated and turned over to law enforcement. IMEI and serial numbers are checked against national databases to prevent fraud.

5. The Trade-In Process

  1. Quote: Get an estimated value online or in-store.
  2. Ship or Bring In: Use our prepaid label or visit a local store.
  3. Inspection: Certified technicians test functionality, authenticity, and condition.
  4. Final Offer: You’ll receive a confirmed amount by email, text, or in person.
  5. Payment: Upon acceptance, we issue payment immediately (in-store) or within 1–2 business days (mail-in).

6. Payments & Fees

  • We pay via your chosen method: Zelle, PayPal, Check, or Cash (in-store).
  • Trade-in credits may be used toward other purchases or upgrades.
  • Shipping or handling fees may apply where disclosed in your quote.
  • Once you accept and payment is issued, the sale is final.

7. Returns & Rejected Devices

  • If your device differs from its described condition, we may revise or rescind the offer.
  • You can decline the revised offer and request your device be returned (you may pay return shipping).
  • Devices unclaimed for more than 30 days after notice may be recycled in accordance with environmental regulations.

8. Compliance & Verification

We comply with all federal, state, and local secondhand-goods and data-security regulations. Transactions may be recorded as required by law. We may refuse service, hold payment, or report transactions that appear suspicious or violate these terms.

9. Digital Communications Consent

By providing contact information, you consent to receive communications by email, SMS, or automated messages regarding quotes, payments, and support. You can opt out of marketing messages at any time without affecting transactional notices.

10. Intellectual Property Rights

All content, trademarks, and designs on SellYourGadgets.com belong to Sell Your Gadgets LLC or its licensors and are protected by U.S. and international laws. You may not copy, modify, or distribute our materials without written permission.

11. Warranty Disclaimer

Our Services are provided “as is” and “as available.” We make no express or implied warranties, including warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not guarantee uninterrupted or error-free operation of our website or mail-in systems.

12. Limitation of Liability

To the fullest extent permitted by law, Sell Your Gadgets is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Services, including but not limited to data loss, lost profits, or shipping carrier errors. Our total liability shall not exceed the amount you received (or were quoted) for your device.

13. Dispute Resolution & Arbitration

In the event of a dispute, please contact us first at info@sellyourgadgets.com. If we cannot resolve it informally, you agree that disputes will be resolved through binding arbitration under the rules of the American Arbitration Association in your state of residence. Each party will bear its own fees unless otherwise required by law. You waive the right to a jury trial or class action.

14. Governing Law

This Agreement and any disputes are governed by the laws of the State of New York (or the state where your transaction occurred), excluding conflict-of-law principles.

We may modify these terms at any time. The most current version will always appear on this page with the updated “Last Updated” date. We encourage you to review it regularly.

Frequently Asked Questions

How long does it take to get paid?

In-store payments are instant after inspection. Mail-in payments usually process within 1-2 business days of receiving your device.

Can I cancel a sale after I ship my device?

Yes. If you decline our final offer before payment, we’ll return your device. Once payment is issued, the sale is final.

What if my device turns out to be locked or blacklisted?

We cannot purchase locked, blacklisted, or stolen devices. Such devices may be returned at your expense or reported to authorities.

What happens if my device is damaged during shipping?

Our mail-in labels include limited carrier insurance. Please package securely. Sell Your Gadgets is not liable for carrier-related loss or damage beyond that coverage.

Do you accept devices with cracked screens?

Yes, we buy most devices with physical or cosmetic damage. The offer will reflect the actual condition after inspection.
